Terms

If website design and/or development has already begun the deposit is non-refundable. The deposit paid to Dozier Studio covers the cost of design work, code development, or any server side configuration carried out. It is not possible to fully refund a deposit once Dozier Studio has begun work on a project. Dozier Studio reserves the right to decide whether a refund, in part or full, is applicable if requested by the Client for any reason. A refund is not guaranteed by Dozier Studio. If a project is cancelled by the Client, it must be in writing, or in the form of an email from the primary Client only. Phone requests will not constitute acceptance of any cancellation.

Any stock photograph or image would include photos and/or images not provided by the Client and purchased on behalf of Client from a supplier, for use in website design or development. A minimum of $10 per photograph or image will be billed to the Client separate from the amount estimated for website design and development unless these stock images are already included in the estimate.

If Dozier Studio will be providing hosting for your web site, full payment is required in advance, before hosting service is established. These hosting charges begin once hosting is established on the server, whether your website is live or not. Invoicing will be sent by e-mail, unless otherwise requested by Client. If payment is not received by the due date, the hosting service may be suspended pending payment. If payment becomes 10 days overdue, the web hosting service may be terminated. Once an account has been terminated, payment in full will be required, including an additional set up fee of $25 to reactivate the account.

If Dozier Studio will be registering your new domain (www.yourdomiainnamehere.com), full payment is required in advance, before registration service is provided. Domain name registration is an annual charge and begins the day it is registered, whether your website is live or not.

Depending on the nature of website changes, prepayment is required. Unless otherwise noted, any and all changes, updates or additions to the website, are invoiced at our standard hourly rate. If payment is not received within 30 days of the invoice date, all changes may be rolled back until payment is received. There may also be a $35 re posting fee added to the outstanding invoice balance.

You may cancel at anytime. If cancellation is received 30 days before your renewal date, then the hosting service will expire midnight or after, the final day. If you cancel with less than 30 days before your renewal date, then you will be obligated for the following month of hosting fees at our monthly rate or 12 months at our annual rate. If you have paid an annual rate and cancel within that time period, Dozier Studio will refund to you the prepaid fees for basic hosting for the full months remaining after effectiveness of cancellation, less any prior fees and charges at our standard monthly rate, plus the waved setup fee of $25 that is included on our annual hosting plans. Accounts that are terminated by Dozier Studio due to default on the part of the Client, will not receive any refund. All cancellations must be received in writing as per the deadlines indicated in writing or by e-mail. Phone requests will not constitute acceptance of any cancellation. Cancellation request will be dated the day that Dozier Studio receives the notice.

If you wish to transfer your hosting to another provider, Dozier Studio can, upon request, download your website to a CD and mail it to you. The cost for this service is $50 for the first copy and $10 for each additional copy. FTP access to your site is not available to an outside service for transfer purposes.

Domain name registration will be automatically renewed under the same time and fee structure unless the Client gives written notice to Dozier Studio thirty (30) days before the renewal date. If a domain name will not be renewed, we must receive notice in writing, or email. If payment is not received by the due date, the domain name may be suspended pending payment. If payment becomes 10 days overdue, the domain name may be locked. Once a domain name has been locked, payment in full will be required, including an additional service fee of $10 to reactivate the domain name.

Normally after a forty (40) day period, domain names enters a thirty (30) day RGP and can only be renewed by first restoring the domain by paying a redemption fee. Redemption fees can run as much as $250 before you can restore ownership. We do our part to make sure that never happens by automatically renewing the domain name on your behalf. However if payment excedes (30) days past due, there will be an additional $25 fee added to the current about due.

If your domain is not registered with Dozier Studio, DNS management services are billable at our hourly rate.

Navigation includes both text and/or buttons that provide a method of moving from page to page on your web site. During our pre production communication, the navigation is decided on, and in most cases includes a link to each and every page on the web site. The main navigation, which appears on every page of the web site will link to all secondary pages ("About Us", "Contact", etc.). Once a site outline is approved, the navigation portion of the web site is designed and coded. Any subsequent changes to navigation, as with any portion of the web site, are billable at our standard hourly rate.

Content is key to any web site. And the provision of content is the Client’s responsibility.

Text content - Content must be provided in digital form, unless you are requesting that the copy be developed by Dozier Studio. Typesetting of non-digital content is considered billable. Clients should provide proof-written copy, unless requested in writing that you would like Dozier Studio to proof your copy before inserting it into the web site. Acceptable digital form can be simply an email, document or PDF file. If we can "copy and paste" your text, then it's considered digital. This saves you hours of billable time.

Copy development and editing – Development of website copy is billable at our standard hourly rate. Development of copy is provided by Dozier Studio once hand written, printed or photo copied versions are provided by a Client and a written request is made for digital copy to be formatted. Digital copies are provided to the Client for approval.

Graphical content - All images, including logos, photos, graphics, etc, created by Dozier Studio are billed at our standard hourly rate. Clients may provide any or all of the graphics or photographs themselves. These must be in digital form or high quality prints. Photos and/or graphics provided in digital form that require only resizing are done so at no charge beyond the regular design and development time. Graphics, provided or not, that require cropping, retouching, correcting, masking (cutting out), improving, layering, etc. will be done at our standard hourly rate.

Entry of data for database applications is considered the role of the Client. A good example of this would be a shopping cart. If a shopping cart is part of your website's development, the products or services would be entered by the Client as needed, once the shopping cart is complete. If needed, Dozier Studio can add, edit or update your shopping cart at our standard hourly rate.

Any and all content, whether in digital or hardcopy form, that is provided by the Client, is considered the property of the Client. Dozier Studio does not share or reuse any content provided by the Client, unless the content is publicly available elsewhere. Dozier Studio respects the Client's hard work in providing this exclusive content and protects it on the Client's behalf just as we do our own work. It is the Client's responsibility to assure that content, photos and images provided to Dozier Studio, are free of any outside copyrights. Dozier Studio reserves the right to reject or dis-include any content that is protected by an outside copyright unless written permission is provided by the copyright owner.

If during the development of your web site, Dozier Studio writes custom source code for a website application, this code is not transferable to a new developer or host. Custom written source code is considered the sole property of Dozier Studio and cannot be shared with other developers in any form, in full or part. Clients of Dozier Studio are granted a license to use this software code while Clients of Dozier Studio. Dozier Studio retains ownership of the code.  Access to or transfer of proprietary source code could result in a security risk to Dozier Studio and all of its Clients who are running similar applications. In order to provide custom software development services, Clients give us access to their most sensitive information, trade secrets, proprietary pricing and business methods. Therefore, neither access to, nor transfer of, any code built for any purpose that is unique and not commonly and publicly available can be granted. Website components that ARE transferable to another host include public side html, php, graphics, logos, pictures, navigation, text, and the data residing within a database. Copies of these transferable files including a full backup of your database if applicable, can be provided on a cd as mentioned in the "Hosting Transfer" section above. Any proprietary source code installed on other hosting servers, outside of Dozier Studio's servers, will be done at the discretion of Dozier Studio and with all rights reserved and implied. Dozier Studio reserves the right to disable any proprietary source code, if deemed necessary due to failure to pay in full, any outstanding invoices, or any exploitation of proprietary source code.

Though not required by law, the customary method of giving notice of copyright is the placement of a branding and copyright in the footer of a web page. As per the United States Copyright Law, Dozier Studio reserves all rights of authorship to code, layout, applications and images created by Dozier Studio, during the creation of any of our products or services, modified or unmodified unless arrangements and a mutual agreement are made before development. This agreement must be made between the Client and Dozier Studio, in writing and as a part of the estimated cost for development. In most cases, we are happy to include the Client's and/or content provider's copyright for the content provided, along side of Dozier Studio's copyright notice. In either case, the provider of content and/or photos and images are considered the author and copyright holder.

We offer limited, in-house phone support to our Clients during standard business hours. Depending on the fault, severity, and time invested, this support may be provided at no charge, split charge, or full standard hourly rate. Dozier Studio maintains and troubleshoots the web sites we develop for our Clients, as well as any domain-based email accounts of those web sites that we host. We do NOT assume responsibility for upkeep or provide non-billable troubleshooting on our Clients' ISP (Internet Service Providers), ISP-based email accounts (yourname@yourisp.com or yourname@gmail.com, etc), your home or office internet connections, routers, computers, software or any other non-domain-based issues outside Dozier Studio's realm of service. Provision of non-domain-based troubleshooting services will be billable at our our hourly consultation rate.
